These are not enforced, but they are encouraged.
Rules:
20-40 FPS is not an enjoyable experience to 95% of gamers. I think in order for your game to be steam deck verified it should run at a stable 60fps. The deck isn't even running at 1080p so if your game still can't achieve 60 fps then it's not a game for the steam deck.
I think a stable 30 is reasonable but I agree that 20-40 is not enjoyable. Honestly even a stable 20fps feels better then highs to lows
