I had dinner at a place that looked almost exactly like this in New Orleans
I've been to half a dozen restaurants that had outdoor seating just like this in America. It's no big deal, can be nice if the weather is suitable.

In the U.S. you can rape children (and adults) and be the president. So I don't think there's much value in comparing things to their legal status in the U.S.
Technically those buildings are only three stories. I have no idea the floor plan, but three deckers with one stairway are definitely allowed. It’s just bigger buildings that need the second stairway
