What leadership at OpenAI really regrets is forgetting to double check that Altman had a non-compete in place. It sounds like he is bringing his favorite employees over to Microsoft.
Pretty sure non competes are largely unenforceable, so probably irrelevant.
Non-competes probably, but non-solicits maybe not.
But how many researchers signed that letter asking the board not to fire Sam?
I don't think Sam needs to solicit for his staff.
Non-solicits are probably not legal in California anyway.
