It's such a ridiculous claim - I don't know why he picked Tutanota, of all providers. If you're trying to make it sound plausible at least choose one in Canada, or a Five Eyes country.
For what it's worth, I was repeatedly harassed by users of Tutanota (I knew who it was, I was looking for proof to get a restraining order), and they stated that short of an international police investigation resulting in a local warrant, they wouldn't disclose anything -- even for people who were violating their terms of service (and therefore should have no expectation of protection under their privacy policy).
Germany doesn't mess around with privacy and data protection.
