The justices will review an appellate ruling that revived a charge against three defendants accused of obstruction of an official proceeding. The charge refers to the disruption of Congress’ certification of Joe Biden’s 2020 presidential election victory over Trump.

That’s among four counts brought against Trump in special counsel Jack Smith’s case that accuses the 2024 Republican presidential primary front-runner of conspiring to overturn the results of his election loss. Trump is also charged with conspiracy to obstruct an official proceeding.

The court’s decision to weigh in on the obstruction charge could threaten the start of Trump’s trial, currently scheduled for March 4. The justices separately are considering whether to rule quickly on Trump’s claim that he can’t be prosecuted for actions taken within his role as president. A federal judge already has rejected that argument.

More abuse of the judicial system. If invading the Capitol building while both houses are in session to count electoral votes after having been directed to do so by the sitting president in order to overturn the election in that sitting president's favor isn't "obstructing an official proceeding," then let's just burn it all down.

The Supreme Court keeps going outside of their jurisdiction. Something needs to be done about them immediately. They are ruining what little democracy we have.

Jack Smith is the one who brought this... I don't really know his end game on this but I assume he wants to get rid of all avenues of escape for the cheeto.

People acting like the Court just took it upon themselves to jump in this. Doesn't work that way.

I have full faith in Jack Smith. If it's in any was possible to put Trump in an orange jumpsuit, this is our guy.

I just wonder what his backup plan is if this fails. NO competent lawyer asks a question he doesn't know the answer to.

Fuck it, let them make the ruling. Then while Biden is in office just arrest every single republican representative. Its fine now, because of the ruling. Fucken rubes.

I believe the Trump administration made the legal argument that anything the president does cannot be challenged if he did it in the belief it was necessary for national security, because that is the first and foremost responsibility of the president and the office itself is the ultimate source of that authority. I think it might have been when they cleared out the protestors in DC, but it was that kind of context.

What I’m wondering is whether that would give Biden the authority to order the arrest of the Supreme Court and members of Congress on the grounds that he believes they’re conducting a conspiracy against the United States and present a threat to the nation and the constitutional order.

Obviously, I’m just kidding.

Don't forget, by undo, you mean to democracy. If ruling in Trump's favor, then Biden could immediately declare himself king, and could literally behead his political opponents.

As much as I really dislike the current SCOTUS, I do have faith that a majority would understand that if they allow this to continue happening, it would set an extremely dangerous precedent to allow more insurrections without repercussions. The only justice willing to allow this is probably Justice Clarence Thomas. Fuck that guy.
