Haven't read the article, but the argument made in the past for these things has been "The prizes have no value and there is no way to 'cash out' therefore it's not gambling."
The argument they gave, cited in the article, is that there's a skill component to them. By which I'm guessing they mean playing Ultimate Team with the contents of the loot boxes, but it doesn't get specific. And I still don't think that would add a skill component to the loot boxes themselves.
In this video game, despite the random allocation of individual digital content from the Packs, the human player can use their own skills to control the course of the game with a probability suitable for success, thus establishing a rational expectation of winning
A game of poker or even blackjack requires skill, so I guess that means it's not gambling?

Alright, did EA bribe these justices?
No need, Austrian courts will make stupid decisions on technology all on their own.
The only possible way that a lot box can be skill based is of they are only given as play rewards. Which I have no problem with. You win a match, you get loot.
But if you can purchase loot boxes, then skill has nothing to do with it.
Is there a cash market for the in-game items?
